The Works Subscription Agreement

Welcome! This agreement explains how our subscription service works and what you can expect from us.

Important Things to Know First

By making your first payment, you're agreeing to these terms. If you're signing up for a company, you need to have permission to do so. This agreement is between Forceworks LLC and one company only - each company needs its own subscription.

1. What You're Getting

1.1 Your Subscription

We're giving you permission to use “The Works from Forceworks” for your internal business needs. We'll keep improving the service over time to make it better for you.

1.2 What's Included

Here's everything you get with your subscription:

Strategic Advice & Consulting

Talk to your dedicated Customer Success Manager anytime during business hours. Plus, get a monthly strategy session with our two principals.

Design Services

Unlimited design sessions with your Success Manager during business hours.

Support

You and your team can submit unlimited support tickets.

Training

Unlimited training calls for you and your team during business hours.

Monitoring

We'll check your system's performance at least monthly.

Data Management

Get unlimited help with importing your data.

Administration

We'll help add/remove users and manage roles when you submit tickets.

Deployment

For new setups, we'll handle the standard deployment process.

Reporting

Unlimited report building for Native Charts, Dashboards, and Power BI (if included in your plan).

Customizations

Unlimited customizations that we can do through the user interface (no coding required).

Automation

Unlimited automations using Power Automate or Native workflows (we'll choose the best option).

Security

Unlimited security role modifications or creation.

Cost Management

We'll review your setup monthly to help control costs.

1.3 What's NOT Included

Development/Coding Work

Anything requiring programming code isn't included (like plugins, custom scripts, APIs, etc.). You can purchase Development Blocks separately for these needs.

Rush Jobs

Standard service assumes normal timelines. For urgent work, you'll need Development Blocks.

Capacity Limits

“Unlimited” means up to our team's available capacity each month (see section 4.5 for details).

Microsoft Compliance

We won't do anything that violates Microsoft's terms of service.

1.4 Your Support Team

Who You'll Work With

  • A dedicated Customer Success Manager
  • Two rotating specialists for additional support

System Access

We'll need access to your systems to help you. You're responsible for providing this access.

Service Classes

We offer different service levels to fit different needs and budgets:

  • Economy Class
  • Premium Class
  • Business Class
  • First Class

Subscription Length

Choose from 1, 3, 6, 12, or 36-month terms.

WorksFlex Option

If you have WorksFlex, you can change your service class or term length with 30 days' notice. Changes take effect at the end of the following month.

2. Pricing & Payment

2.1 How Long This Agreement Lasts

Your initial term is the length you selected. After that, it automatically renews for the same length unless either of us gives 30 days' notice before the term ends.

2.2 Payment Details

  • All prices are in US Dollars
  • Foreign currency payments: Add 3% surcharge
  • Payments are due monthly in advance via auto-pay (ACH)
  • Wire transfers: Add 3% handling fee
  • We don't accept mailed checks
  • Annual price increases based on US inflation rate (Consumer Price Index)

2.3 Taxes

You're responsible for all taxes except those on our net income. If we're legally required to collect taxes, we'll add them to your invoice unless you provide a valid tax exemption certificate.

2.5 Late Payments

Late payments incur a 1.5% monthly charge (or the maximum allowed by law, whichever is less).

3. General Legal Stuff

3.1 Who This Agreement Covers

This agreement is just between you and us - no one else can claim rights under it. We're independent businesses, not partners or employer/employee. We may list you as a customer in our marketing materials.

3.2 Don't Hire Our People

During your subscription, please don't try to hire or contract with any of our team members who work on your account without our written permission.

3.4 Things Beyond Our Control

Neither of us is responsible for delays caused by events beyond our control (like natural disasters, internet outages, war, terrorism, etc.).

3.5 This Is Everything

This document is our complete agreement. It replaces any previous discussions or understandings. Changes must be in writing and agreed to by both parties. Any purchase orders you send won't change these terms.

4. Additional Important Information

4.1 Third-Party Products

If we offer products from other companies, those come with their own terms. We're not responsible for third-party products or services.

4.2 Keeping Information Private

We'll both keep each other's confidential information private, using at least the same care we use for our own sensitive information. This doesn't apply to information that's:

  • Already public
  • Known in the industry
  • Becomes public (not through our fault)
  • Received legally from others
  • De-identified data

We can share confidential information when required by law or court order.

4.3 Your Data Belongs to You

You own all your data. We can use your company name and logo in our marketing materials.

4.4 Changes We Might Make

To the Service

We may update the service and will notify you of major changes. We reserve the right to discontinue the service but will give you notice.

To These Terms

If we make important changes to these terms, we'll email you or post a notice in your account. If a change negatively affects you and you disagree, tell us within 30 days. You'll keep your current terms until your renewal, then the new terms apply.

4.5 Understanding Service Capacity

Our team members have 30 productive hours per week. Your service class determines how many customers share a team:

  • Economy Class: Up to 6 other customers (bi-weekly calls)
  • Premium Class: Up to 3 other customers (weekly calls)
  • Business Class: 1 other customer maximum (weekly calls)
  • First Class: Dedicated team just for you (unlimited calls)

“Unlimited” services are subject to your service class's available capacity. If we can't complete something this month, it rolls to next month.

4.6 Nonprofit Pricing

To qualify for nonprofit rates, you must be approved by Microsoft as a nonprofit. You need to maintain this status and tell us immediately if it changes. If you lose nonprofit status, you'll be switched to regular pricing.
